Off The Beaten Track WA Terms & Conditions


By booking with Off The Beaten Track WA, you agree to these Booking Conditions and Waiver. Together, these form your agreement with us. Please read them carefully.

  1. Bookings and Contract

     

  • A booking is confirmed when we issue a confirmation invoice or accept full payment (if booking within 15 or 60 days of departure, depending on tour type).
  • You are responsible for ensuring all participants included in your booking understand and agree to these terms.
  • If someone books on your behalf, you agree they may make amendments or cancel on your behalf.

     

  1. Pricing and Payment

     

  • All prices are per person (unless stated), in Australian dollars, and subject to change until confirmed.
  • To secure your booking for private tours/multi-day tours, a non-refundable deposit is required:
    • 20% of the total price.
  • Full payment is due:
    • 60 days before departure for multi-day tours or private tours
  • To secure your booking for public day tours, full payment is required at the time of booking.
  • All bookings made via Stripe or PayPal incur a 2.9% + $0.30 transaction fee. 
  • Payments made from overseas bank accounts must pay the invoice in full at the time of booking. Any applicable bank and/or transaction fees are not payable by Off The Beaten Track WA.


Our prices are subject to change based on demand, seasonal factors, and availability. While we aim to keep pricing accurate on our website, we reserve the right to correct errors and update advertised prices at any time before a booking confirmation is issued.

We may also apply a surcharge up to 60 days before departure if there are significant increases in costs beyond our control (e.g. transport, local operator fees, taxes, or government action).

  • We will absorb any increase up to 2% of the trip price.
  • If a surcharge exceeds 10%, you may cancel within 14 days of notification and receive a full refund.

     

  1. Booking Amendments and Transfers

     

  • You may transfer your booking to another person provided:
    • You notify us in writing with their full details no later 48 hours prior to departure; and
    • They complete and return the waiver, and meet all participation requirements.
  • Transfers to another tour are only permitted where operationally possible and may incur additional costs, however please refer to the cancellation terms below, i.e. Can transfer to another day tour 15+ days from departure with no cancellation fee.
  • For any changes within 60 days of departure for multi-day tours & private tours, the below cancellation fees will apply.

     

  1. Cancellations by You

     

Public Day Tours

  • 15+ days: Full refund minus 10% admin fee + booking & transaction fees.
  • 8–14 days: 50% cancellation fee
  • 7 days or fewer: 100% cancellation fee

     

Private Tours & Public Multi-Day Tours

  • 61+ days: Deposit held as credit
  • 31–60 days: 50% cancellation fee
  • 30 days or fewer: 100% cancellation fee      
                           

No Shows: 100% cancellation fee applies.

Refunds exclude booking and transaction fees and any unrecoverable costs from third-party suppliers. We strongly recommend travel insurance to cover cancellations.

Credits issued:

  • Are valid for 12 months from date of issue
  • Are not transferable
  • Are not redeemable for cash

     

  1. Cancellations by Us

     

We reserve the right to cancel any tour due to:

  • Weather, bushfires, or other environmental conditions
  • Minimum numbers not being met
  • Force Majeure (see section 6) or other unavoidable disruptions

     

In the event of cancellation, we will offer:

  • A full refund (minus any unrecoverable costs and transaction fees), or
  • A credit toward another tour (valid for 12 months from date of issue)

     

We are not liable for incidental costs (e.g. non-refundable accommodation).

  1. Force Majeure

     

A Force Majeure Event is any event beyond our control that makes it unsafe, impractical, or impossible to operate a tour. This includes (but is not limited to): natural disasters, fires, extreme weather, pandemics, government restrictions, war, civil unrest, or failure of third-party services.

If a tour is cancelled due to a Force Majeure Event:

Before Departure

You will be offered:

  • A 100% credit of monies paid, OR
  • A refund, minus any unrecoverable costs and transaction fees

     

After Departure

You will be offered:

  • A credit or refund (minus unrecoverable costs) for unused days

     

Credits issued:

  • Are valid for 12 months from date of issue
  • Are not transferable
  • Are not redeemable for cash

     

  1. Liability and Risk

     

  • Our services come with guarantees under Australian Consumer Law, which cannot be excluded.
  • To the fullest extent permitted by law, we are not liable for:
    • Any injury, death, loss, death, damage, delay, or additional expense incurred due to sickness, weather, strikes, acts of God, Government action, acts of terrorism, criminal activity, war, quarantine, any other force majeure events or any other cause beyond our control. All losses or expenses you may incur from such risks eventuating must be borne by you.
    • Acts or omissions of third-party providers.
  • You acknowledge that hiking and adventure travel involve inherent risks, including exposure to natural elements and physical exertion.
  • You are responsible for assessing your personal fitness and understanding any medical risks involved.
  • For the safety of all guests and guides, Off The Beaten Track WA reserves the right to refuse service if guests are believed to be impaired by alcohol/drugs, or if we deem a guest is unable to complete the tour due to a lack of fitness or ability. No refunds will be provided in these cases.
  • In the event that any legal action, arbitration, or other proceeding arises with respect to enforcing, interpreting or construing these terms and conditions, or concerning any grievance relating to the booking, the party who prevails shall be entitled to recover its reasonable legal fees and expenses on a solicitor/client basis.
  • You will be required to acknowledge and agree to our waiver of liability prior to participation (either electronically through our booking platform Rezdy, or by completing the ‘Guest Information & Waiver Form’ if booking through any other agent or platform).

     

  1. Third-Party Providers

     

  • We may engage third-party operators (e.g. transport providers, accommodation, local guides).
  • While we take reasonable care in selecting these providers, we are not responsible for their actions or services.
  • You may be required to agree to their separate terms and conditions and sign additional waivers.

     

  1. Photography and Promotion

     

By participating in our tours, you consent to Off The Beaten Track WA:

  • Taking photographs, video recordings, and/or film footage of you during the experience; and
  • Using this content on our website, social media, advertising, or other promotional materials, without further permission or compensation.

     

If you do not wish to be photographed or filmed, please notify your guide prior to the tour commencing.

  1. Complaints

     

If you have any issues during your tour or experience, please speak to your guide at the time so we can try to resolve the issue promptly.

We aim to investigate and respond to complaints fairly and promptly.

  1. Governing Law

     

These Booking Conditions are governed by the laws of Western Australia.

Any disputes will be resolved exclusively in the courts of Western Australia
