Conditions of Booking
It is a condition of booking that you have read and understood these Terms & Conditions prior to making your booking. If there is anything you are unsure about then it is your responsibility to contact off The Beaten Track WA and request clarification.
Prices are quoted in Australian dollars. Prices are per person, are correct at time of promotion and although unlikely, may be subject to change at the discretion of Off The Beaten Track WA.
Conditions of Travel
Off The Beaten Track WA reserves the right to alter the route or itinerary of any of its experiences if required. No refunds will be given in these circumstances or in the event of a delay or alteration of a trip resulting from any cause beyond our control, including but not limited to severe weather conditions. Off The Beaten Track WA will endeavour to deliver the experience as presented and will only make changes which are in the best interests of our clients.
Experiences may require minimum numbers to operate. In circumstances where minimum numbers are not reached, an alternative may be offered or refund given.
Whilst we make every effort to safeguard our clients, Off The Beaten Track WA cannot be held liable for any damage, injury, or loss of any kind caused by or resulting from any act or omission by its employees, agents or contractors. Clients should note that outdoor hiking experiences involve a higher than normal risk and a signed waiver will be required before commencement of your experience.
By booking an experience with Off The Beaten Track WA, the client agrees that Off The Beaten Track WA and its guides will not be held responsible for any death, injury, illness, delay, damage or loss of any nature caused by the operations of Off The Beaten Track WA and its operators. This is held true whether or not it is due, or alleged to be due to negligence, misconduct or breach of conduct on the part of Off The Beaten Track WA or its operators. Passengers expressly renounce all claims against Off The Beaten Track WA and its operators in respect of such death, injury, illness, detention, delay, damage or loss.
Due to the meticulous and extensive organisation involved with creating Off The Beaten Track WA experiences, a strict cancellation fee will be applicable to compensate for costs and lost revenue.
Once a booking is made the following cancellation fees will apply:
No-shows and cancellations received within 48 hours of hike departure will incur a 100% cancellation fee.
Cancellations received 48hrs – 1 week prior will incur a 50% cancellation fee.
Cancellations received 1 week + can have a full refund or credit towards another event.
Customers can transfer their booking to a friend or family member with no penalty but must advise in writing so Off The Beaten Track WA can provide confirmation information to this individual.
All bookings are made via Stripe or Paypal. Off The Beaten Track WA will incur the 2.9% + $0.30 transaction fees for the booking transaction.
If a customer cancels their booking within the timeframes eligible for a full/part refund. Their refund amount will be minus the transaction fees of the original booking.
If you fail to join an Experience or join it after departure, or leave it prior to its completion, no refund can be made. Cancellation fees apply as soon as Off The Beaten Track WA confirms or accepts a reservation.
Cancellation by Off The Beaten Track WA
We may cancel an experience at any time prior to departure if, due to severe weather, terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned event. If we cancel your experience, you can transfer amounts paid to an alternate departure date or alternatively receive a full refund. In circumstances where the cancellation is due to external events outside our reasonable control refunds will be less any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking being cancelled.
You give permission for Off The Beaten Track WA to use any digital, film or video photographs they may take of you, your family or your vehicle, in their advertising, or website.
This Agreement is and shall be governed by and construed in accordance with the law of the State of Western Australia. Any legal conflict which may arise under this Agreement shall be resolved in the legal jurisdiction of Western Australia.
